SEP 1 7 RECD MEMORANDUM TO: Allen Clark FROM: ichard English M' SUBJECT: Discussion of Alternatives for the Selection of Judges DATE: August 29, 1930 The discussion of the available alternatives for a system for the selection and retention of judges in the memoranda attached is not in my view adequate to submit to the Governor for his consid- eration. There is not sufficient discussion of the public policy aspects of this decision. That is, the problem of whether a particular system is best for the people of this State in terms of producing a better quality of justice and a more qualified and able bench has not been discussed as fully as it should have been. (45""— Furthermore, I think it would be helpful to the governor to have the views of all the participants in the same format. He would thus be better able to compare the views of the various partic- ipants. Therefore, I have prepared the attached memorandum which asks the respondent to submit his views to the governor. Attached to it is an outline for each respondent to use in organizing his views for presentation. I recommend that Douglas Brown use this memorandum to ask each of the persons who have already participated to submit his views. I r In addition, the memorandum might be accompanied by any one of the following as a stimulant to the thinking of the participants: o The memoranda already written by Dean, Cicconi, Kaster, .•. and Strake. o My summary of the main points made by those memoranda. Perhaps it would be best not to include any of them since it might tend to bias the results of the effort. Also, such a wide distirbution might tend to inhibit future memoranda if the first alternative above were pursued. I recommend that we not submit any of the above, but that the memorandum and outline alone be sent.
