Estelle - Discussion with Brad Reynolds Brad Reynolds issued an oral statement to the press generally as follows: (1) It is his policy not to tell the press the particulars of any discussions concerning pending lawsuits and, therefore, would not comment on what he discussed with Mark White or with you, other than for say; (2) The Department of Justice is anxious to have negotiations with the State about overcrowding and to settle it and all other issues in the lawsuit; and (3) He would not say that Mark White was misrepresenting his position on single-celling other than to state that his and the Justice Department's position on it was as stated on page 92 of his 5th Circuit Brief, which he quoted to the press. Even though I told him we wanted a stronger statement, he would not do more. He did say that if asked by the press, he would not deny you and he talked about settling the overcrowding issue on a basis other than single-cells. DH: sr DAVID HERNDON General Counsel
