PROCLAMATION BY THE Gourrmar of UR -fttir of &)xao 41-1832 TO ALL TO WHOM THESE PRESENTS SHALL COME: WHEREAS, there is currently an identified infestation of the Mediterranean Fruit Fly in certain vegetable and fruit producing counties in California; and WHEREAS, shipments of California fruits and vegetables are continuing to pass into and through the State of Texas subjecting Texas' produce industry to widespread and severe damage from the Mediterranean Fruit Fly infestation; and WHEREAS, there is an imminent threat of widespread and severe damage to the State of Texas and its fruit and vegetable industry if the influx of the Mediterranean Fruit Fly is not halted; and WHEREAS, Title 7, USCA, Section 161, provides in part, "That any nursery stock, plant, fruit, seed, or other product or article, subject to the restrictions of this section, a quarantine with respect to which shall have been established by the Secretary of Agriculture under the provisions of this chapter shall, when transported to, into, or through any State, Territory, or District, in violation of such quarantine, be subject to the operation and effect of the laws of such State, Territory, or District, enacted in the exercise of its police powers, to the same extent and in the same manner as though such nursery stock, plant, fruit, seed, or other product or article had been produced in such State, Territory, or District, and shall not be exempt therefrom by reason of being introduced therein in original packages or otherwise."; and WHEREAS, a quarantine has been established by the Secretary of Agriculture under the authority of Title 7, USCA, Section 161, for certain counties in California; and WHEREAS, the Governor of Texas has the authority and responsibility to protect the state and people of Texas from disasters including infestations under Article 6889-7, Vernon's Annotated Civil Statutes. NOW, THEREFORE, I, William P. Clements, Jr., in and by the authority granted to me as Governor of the State of Texas and pursuant to the Texas Disaster Act of 1975, Article 6889-7, Vernon's Annotated Civil Statutes, do hereby make the following proclamation having full force and effect of law. 1. All inspectors currently employed by the State Department of Agriculture are temporarily reassigned to the State Division of Disaster Emergency Services. 2. The Department of Agriculture's inspectors and personnel of the Texas Depart- ment of Public Safety will stop motor vehicles entering the State of Texas at locations and at a rate of frequency determined by the Department of Agricul- ture inspectors to determine if they are carrying produce from the State of California. 3. California produce which has been inspected and approved under the Plant Quarantine Act, Title 7, USCA, Section 161, by federal officials in California will be exempt from this proclamation. All other produce originating from California will be inspected by the inspectors to deter- mine if it is infested by the lediterranean Fruit Fly. 4. Any produce from the quarantined California counties not accompanied by such documentation, or California produce found to be infested with the Mediter- ranean Fruit Fly will be immediately destroyed at the carrier's expense or the care.ier and produce will be denied entry into the State of Texas.
