FROM: Johnny McCollum...0A, RE: PROPOSED ORDER TRANSFERRING TEXAS DEPARTMENT OF CORRECTIONS INMATES TO FEDERAL CUSTODY On September 18, 1979, I signed a copy of the proposed order transferring inmates who testified in the Ruiz suit as Plaintiffs' witnesses to federal custody. The main factors of the proposed order are: 1. Because inmates who testified for Plaintiffs fear retaliation by T.D.C. officials, they have the opportunity to transfer to the Federal Bureau of Prisons 2. All costs of transferring and maintaining these prisoners will be borne by the federal government. 3. All parole, executive clemency, and mandatory supervision decisions will be in accordance with Texas law, with the Governor still maintaining the final decision in all matters. 4. Disciplinary infractions, good time credits, and promotions will be joint decisions between Federal Bureau of Prisons and Texas Department of Corrections authorities. 5. Each inmate who participated will have one opportunity to go to the Federal Bureau of Prisons and one opportunity to return to T.D.C. Should an inmate elect transfer to the F.B.P. and then decide to return to T.D.C., the cost of this transfer will also be borne by the federal government. In the order I signed, we stated that we are aware of the contents of the order and agree to facilitate its execution. Should we be so lucky as to have all 91 inmate witnesses transfer the resultant savings to our taxpayers will be approximately $680 per day ($249,000 a year). Further, T.D.C. officials state that a great majority of the inmates involved are among the worst at T.D.C., therefore the transfer of these prisoners will be beneficial to T.D.C. in other aspects.
