Box 4142 Bryan, Texas 77801 (713) 822-5447 Brazos and Robertson Counties JUL 0 2 RECD During the six sessions that I have served in the legislature it has never been clear as to precisely what authority, if any, the governor has in the vetoing of riders in the general appro- priations bill. Earlier derisinns have demonstrated that his power is limited, but to what extent has not been clearly established - at least not to my satisfaction. Consequently I am asking the Attorney General to rule on the validity of the veto of the six riders to the general appro- priations bill. Attached is a copy of my request to the Attorney General. I have no o.uarrel with giving you, Governor Clements, or any other governor certain powers over the budget. In fact, I have consistAfitly supported legislation that would increase the powers of the governor. But until those powers are granted, either by statute or by constitutional amendment, it is in- cumbent that current law be clearly defined and it's integrity tained. By requesting an opinion on these riders, future egiSlatures, and governors, will be better informed and the palance of powers as provided in our constitution maintain it's integrity. haVe enjoyed working with you these first six months of your administration. I thought it was a good session. I -trust that you will accept my request of the Attorney General in the spirit that I have submitted it. I certainly do not intend it as an affront to you or your administration. I look forward to working with you in the future in providing good, sound, conservative policies for Texas.
