OCT 1 8 RECD Office of the Governor MEMO TO: Tobin Armstrong FROM: Dary StoneW DATE: October 18, 1979 RE: HIDALGO COUNTY DISTRICT ATTORNEY Austin, Texas 78711 Phone (512) 475-3021 e)) I spoke with Judge Evans this morning and he has turned around and agreed with our interpretation of the law. For your purposes, what this means is that: 1. When Judge Evans renders his judgement of disbarment, it will not automatically create a vacancy in the office of the District Attorney for which we have to fill immediately. a. The disbarred District Attorney will have the opportunity to appeal his case. 2. The interim District Attorney may continue in his duties pending final disposition of the disbarred District Attorney's appeal. 3. You should wait to hear from Andy Shuvall when the process is finally completed, both the legal appeal and the actions necessarily taken by Andy Shuvall's outfit. DS:sfb cc: David A. Dean Linda Howell
