State Property Tax Board case. I would urge that the special session be opened to consider a permament solution for the funding of capital improvements of all institutions of higher educa- tion. I have every confidence that there are adequate funding sources available without using an ad valorem tax to solve this problem. I am certain you have heard reports of a possible challenge to the Permanent University Fund if a permanent solution for funding of non- PUF schools is not found. I am confident that such a challenge would be successfully defended; however, I am sure you would agree that it would be better to avoid such a dispute if possible.
