Daniel RE: Fifth Circuit Ruling in the Prison Case DATE: June 24, 1982 Governor Clements Campaign 805 Brazos Austin, Texas 78701 512 472-1982 Two thoughts on the reversal of Judge Justice's order governing TDC operations: We should emphasize the opportunity to take control of the prisons out of the hands of the judges and lawyers and put it back in the hands of the TDC board and its expert advisors, namely the Governor's Blue Ribbon Task Force on the Justice and Corrections System. Remember that White was able to win this round of the lawsuit (the first real victory he has had as AG) only with the assistance of expensive outside counsel. At the debate between Strake and Hobby at the Houston Chamber of Commerce, Hobby argued that TDC would not be behind in its construction program if the Governor had not vetoed the prison construction funds in 1979. If this keeps up, we will have to be indignant about the veto not delaying construction and not affecting the outcome of the prison suit.
