PROCESS (1) Determination of compliance or non-compliance by H.E.W. * (2) H.E.W. notifies the State of the alleged non-compliance and makes a good faith effort to secure voluntary compliance by the state. (3) H.E.W. concludes that voluntary compliance cannot be secured N and decides that the voluntary compliance phase has ended in o s-r-AtTx H-A-S failure. C.0.50 PAsr Tofi'S pc,i0T, 44---ITT H.E.W. holds administrative hearing and makes express finding of Title VI non-compliance in the particular program or activity (5) After Secretary of H.E.W. accepts the finding of non-compliance he prepares his final order and submits report to the House and Senate Committees that have jurisdiction over the program (6) If the committees find no fault with the order the Secretary of H.E.W. notifies the state of the action H.E.W. will take in regard to the termination of the funds. (7) State may obtain Judicial Review of H.E.W. 's action under the Administrative Procedures Act. * The stage we are about to enter
